Universal ankle support brace: distinguishing 9021, 3926 and 6307

A universal-size ankle support approximately 26 cm long. It consists of two anatomically shaped rigid plastic side shells covering the ankle joint and part of the calf, removable foam padding covered with woven textile, an adjustable textile heel bridge and two inelastic hook-and-loop straps at calf level. It is worn inside a shoe to limit sideways twisting after ankle or ligament injury. There is no tightening or patient-specific adjustment at the ankle joint.

Classification is based on General Rules 1, 3(c) and 6, Note 7(d) to Section XI and the wording of CN codes 6307, 6307 90 and 6307 90 98. The plastic shells and textile straps are equally important to the support function, so no single material gives the article its essential character under Rule 3(b). Between headings 3926 and 6307, which merit equal consideration, Rule 3(c) selects 6307 because it occurs last in numerical order.

Heading 9021 10 10 for orthopaedic appliances was excluded: the article is universal size, is neither made nor adjustable to a particular user's ankle and tightens only at the calf. It therefore lacks the patient-specific adaptability required for that heading. Heading 9021 10 90 for splints and fracture appliances was also excluded because it cannot completely immobilise a fractured ankle. Product names, medical use and rigid side shells do not by themselves determine heading 9021.

The Regulation is directly binding in EU Member States; it does not automatically create a final 12-digit Turkish GTIP or binding BTB. It is nevertheless a strong comparative source for the 6307–3926–9021 distinction involving ankle supports, ankle braces, orthoses and sports ankle stabilisers. Patient-specific adaptability, joint-level adjustment, degree of immobilisation and the roles of textile and plastic components require separate verification.
