Is every LED article a lighting fitting? EU clarification on heading 9405
A light source does not automatically make an article a lighting fitting for tariff purposes. The EU clarification published on 9 October 2026 explains the exclusion of certain purely decorative illuminated articles from heading 9405.

The article’s primary function determines the distinction
The clarification concerns articles of glass, metal, plastics or other materials designed merely for indoor or outdoor decoration. LED strings, strips or similar lights enhance their ornamental character. These articles are not primarily designed to illuminate a room or area: their light output is too low for functional lighting and they are not specialised lamps.

How are articles outside heading 9405 classified?
Articles meeting these criteria are classified according to the constituent material of their decorative component. A photograph, commercial name or LED description alone does not establish a final HS code or Turkish GTIP. For the actual goods, heading texts, Section and Chapter Notes and the General Interpretative Rules must be considered together. For mixed-material goods, component functions and, where required by the applicable rules, essential character need assessment.
A solar panel does not determine the result on its own
Referring to Figure 7, the official note states that the presence of solar panels is not relevant to classification under heading 9405 for such decorative articles. This does not cover all solar-powered lamps. An article primarily designed for functional lighting requires a separate assessment.
A decorative lamp is not the same as an illuminated ornament
A lamp with an attractive or decorative design may provide functional lighting or serve a specialised lighting purpose. The commercial description “decorative” therefore does not by itself exclude heading 9405. Design, the role of the light and the article’s overall objective characteristics matter.
How should this be read for Türkiye?
This document adds an explanation to the EU Combined Nomenclature Explanatory Notes. It does not establish a direct amendment to Türkiye’s Customs Tariff or a binding Turkish BTB. It should be read as a comparative technical reference. Türkiye’s national tariff subdivision and relevant national provisions must be verified separately for the actual goods.
What information should be requested for a similar product?
- Primary intended use and design
- Luminous flux, power, light distribution and any photometric data
- Decorative body material and component list
- Roles of the LEDs, battery and solar panel
- Technical catalogue, instructions and product photographs
The note sets no fixed lumen threshold. Technical data, design and intended use should be assessed together. Classification outside heading 9405 does not by itself establish an exemption from CE/TAREKS or other import controls; their scope requires separate review.
